The website 25math.com, along with the site in connection with 25math.com, are owned, operated, maintained, and or used, as applicable, by 25math.com (“we,” “or,” or “us”). By using these services, including payment for a lesson, attending a lesson, visiting this website, or registering for an account in conjunction with the Service, you agree to the terms and conditions set forth below (Terms) and are bound by them.
If you do not agree to these Terms, you should not use the 25math.com website or any affiliate services on 25math.com or connected websites. For the purposes of this agreement, “you” is defined as the parent or adult who is paying for the service, in addition to the student who is using the service. If you are a parent, guardian, or other person who enables a child to access the Services, you agree to stand in the shoes of such child for the purposes of making us whole in case of damages or indemnification that could properly lie against a child, if not for his or her age.
If someone else is paying for or authorizing your account, you agree to print out a copy of the Terms and hand the document to them.
Description of Service
Via our Services, website, and outside websites, we enable users to connect with independent contractor tutors (“Instructors”) who provide live instruction to one or two users at a time. This Service is held on third-party websites, which includes both a service for registering for such lessons as well as the service that enables instructors and students to interact in real-time.
25math.com requires that all instructors pass a third party verification service (“Verification Service”), which constitutes a reasonable effort to confirm the validity of the Instructors’ lack of criminal history and claimed educational credentials. We do not control, and are not responsible for, the Verification Service or any information that is provided by the Verification Service. We do not endorse any warranties or representations concerning the reliability of the Verification Service or Instructors.
Changes to Terms of Use
With or without notice to you, 25math.com reserves the right to change these Terms at our sole discretion. It will become effective immediately upon posting to the site. Your continued use of the Services constitutes agreement to such modifications. You agree to regularly review the current version of these Terms as posted on the site.
Registration Obligations
To use the Services provided by 25math.com, you must register on a third-party site. You are fully responsible for the confidentiality of your account(s), username(s), and password(s) and for all activities under your account(s), username(s), and password(s). You are also responsible for any data given to you that is used to connect to an Instructor via a third-party service. You could be held liability for any losses incurred by us or another party due to someone else using your account(s), username(s), password(s), or data that is used on 25math.com or third-party websites.
You may not transfer your account(s), username(s), or password(s) to another person. In the event that you have authorized another individual, including but not limited to a minor, to use your account(s) or other information needed for the Services of 25math.com, you are fully responsible for (a) the conduct of such user; (b) controlling the user’s access to and use of the Services; and (c) the consequences of misuse. If you permit a minor to use your account(s), we reserve the right to provide access to your account(s) and all information to such minor’s parents, guardians, or other authorized adults.
You agree to provide (a) true, current, accurate, and complete information about yourself as prompted by the third-party website (such information as “Your Data”), (b) promptly update and maintain Your Data to keep it true, current, accurate, complete, and current; and (c) comply with these Terms. If Your Data is not true, inaccurate, not current, or incomplete, or if we believe that Your Data is not true, inaccurate, not current, or incomplete, we reserve the right to suspend or terminate your account, as well as refuse current and future use of the Services, or any portion thereof.
If you reside outside of the United States, your registration indicates your explicit consent that the personal information you have provided may be transferred and stored in countries outside your home country, including the United States.

User Content
25math.com does not require any personal information to be held by the site. Your creation and use of an account on a third-party website, agreeing to meet an Instructor on a third-party website, or direct contact with 25math.com signifies your willingness to share any given information that you provide. 25math.com is not responsible for the safety and security of your information that is held by other services.
Any information, materials, or communications that you upload, communicate, or otherwise transmit or post (“User Content”) to us, the site, the Instructors, the Services, or any affiliate methods of communication, will be treated as non-confidential and non-proprietary, and may be disseminated or used by us for any purpose whatsoever, including, but not limited to, quality control and professional development, as well as our developing, manufacturing, and marketing our current and/or future Services. By uploading or otherwise making available any User Content, you automatically grant and/or warrant that the owner has granted to us the perpetual royalty-free, non-exclusive, world wide right and license to use, reproduce, modify, publish, distribute, perform, display, and transmit the User Content for any purpose, with the exception of academic source materials such as textbooks and workbooks, which you assert you are entitled to upload under the “fair use” doctrine of copyright law. In addition, if you request that the third-party system display a representation of a page or problem from a textbook or workbook, you expressly warrant that you are in proper legal possession of such a textbook and that your instruction to our system to display a page or problem from your textbook is made for the sole purpose of facilitating your tutoring session, as a classic example of “fair use” under copyright law.
You also agree that we may record all or any part of any Services on the third-party website for quality control and other purposes. We reserve the right to review the Tutoring Sessions for any purpose. Notwithstanding anything to the contrary above, you agree that we own all transcripts and recordings of Tutoring Sessions and all comments that you may provide to us on or through the site, the Services or any other means, such as as a part of user satisfaction or other similar surveys, and that these Terms shall be deemed an irrevocable assignment of all such transcripts and comments, each portion thereof and all intellectual property rights therein to us.
Copyright
All content included on the 25math.com website and delivered to subscribers as part of the service, including text, graphics, logos, designs, photographs, button icons, images, audio/video clips, digital downloads, data compilations, and software, is the property of 25math.com, or its suppliers and is protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of 25math.com, and protected by U.S. and international copyright laws. Content shall not be reproduced or used without express written permission from 25math.com, or its suppliers. You agree not to decompile, reverse engineer or disassemble any software or other products or processes accessible through the 25math.com website, not to insert any code or product or manipulate the content of the 25math.com website in any way that affects the user’s experience, and not to use any data mining, data gathering or extraction method. 25math.com reserves the right to terminate your membership hereunder if 25math.com, in its sole and absolute discretion, believes that you are in violation of this paragraph, such violations including the copying of content provided to you by us or the copying or other unauthorized use of our proprietary content. This may include Instructors sending links to Third Party Sites and/or causing Third Party Sites (such as study resources or online education pages) to pop-up for your review. Because we have no control over Third Party Sites, you acknowledge and agree that we are not responsible for the availability of Third Party Sites, and do not endorse and are not responsible or liable for any content, advertising, products, services or other materials on or available from Third Party Sites. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, advertising, products, services or other materials available on or through any Third Party Sites or for any mistakes, defamation, libel, slander, omissions, falsehoods, obscenity, pornography, or profanity contained therein. Conduct
You may only access the site and use the Company Content and the Services for lawful purposes. You agree that you will treat the Instructors with respect and not use obscenities in the classroom, make threats, or discuss matters other than those directly related to the academic subject for which you seek help. You agree that you will not solicit any personal information from any tutor, and agree that if any tutor ever discloses such information to you, asks you for any personal information, or suggests any offline meeting or conversation, you agree to immediately report this to us by phone and in writing.
Breach of these standards can result in account(s) suspension, termination, and refusal of service by 25math.com in the present or future. 25math.com reserves the right to withhold refunds in these instances as well.
